IMPORTANT PRIVACY NOTICE
GigePay®, LLC, dba GigPaytm and our subsidiaries (collectively “GigPay”, “us,” or “we”), collectively form a technology services firm that offers web-based applications and mobile applications, as well as application programming interfaces (“API’s”) to facilitate payments, savings, financial transactions and other financial services along with other features and functionality (collectively, the “Platform”). As explained below, we collect information from you when you interact with the Platform.
Collection of Information
GigPay may collect non-personally identifiable information from you regarding your usage of the Platform (“Non-Personally Identifiable Information”), including, without limitation, website pages, videos, blogs and presentations viewed, the amount of time spent using certain features of GigPay, demographic data such as server location, frequency of visits, cookies existing on your computer, search criteria used and results, date, time, the last website you visited prior to visiting GigPay, financial balances and transactions, and other information which does not specifically identify you. We collect this information by using technology including, but not limited to, cookies, log files and web session variables. “Cookies” are pieces of information that may be placed on your computer by a website for the purpose of facilitating and enhancing your communication and interaction with that website. You may stop or restrict the placement of our cookies on your computer by adjusting your web browser preferences. If you do so, you may still use the Platform, but this may interfere with some of its functionality. We may also collect information from you when you sign up for an account, fill in forms on GigPay, or call, text or send us an email which may enable us to identify you personally, including things such as your phone number, email address, name, Internet protocol address (“IP address”) or physical address (“Personally Identifiable Information”). We may use Google Analytics, which uses first party cookies to report on your interactions with GigPay. Google Analytics collects information including, but not limited to, the time of each of your visits to GigPay, whether you have visited GigPay before, what site referred you to GigPay, and what pages you viewed on GigPay. We may use similar vendors or software providers at our sole discretion and without prior notice.

GigPay respects the intellectual property of others, and we ask you to do the same. If you or any third-party believes its copyright rights have been infringed on our Platform, the copyright(s) owner (“Complaining Party”) should send notification to Our Designated Agent (as identified below) immediately. To be effective, the notification must include: (i) a physical or electronic signature of the Complaining Party or such person authorized to act on behalf of the Complaining Party; (ii) identification of the copyrights(s) claimed to have been infringed; (iii) information reasonably sufficient to permit us to contact the Complaining Party or such person authorized to act on behalf of the Complaining Party, such as address, telephone number and, if available, an electronic mail address at which the Complaining Party may be contacted; (iv) identification of the material that is claimed to be infringing the Complaining Party’s copyrights(s) that is to be removed and information reasonably sufficient to permit us to locate such materials; (v) a statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, agent, or by law; and (vi) a statement that the information in the notification is accurate and, under penalty of perjury, the Complaining Party or such person authorized to act on behalf of the Complaining Party is the owner of an exclusive copyrights that is allegedly infringed.

You acknowledge, accept and agree that if we receive a notice of a claim of copyright or other intellectual property infringement, we may immediately remove the identified materials from our Platform without liability to GigPay or any other party and that the claims of the Complaining Party will be referred to the United States Copyright Office for adjudication as provided in the DMCA. Please note that this procedure is exclusively for notifying GigPay and its affiliates that your copyrighted material has been infringed. The preceding requirements are intended to comply with our rights and obligations under the DMCA, including 17 U.S.C. §512(c), but do not constitute legal advice. It may be advisable to contact an attorney regarding your rights and obligations under the DMCA and other applicable laws. Allegations that other intellectual property right is being infringed should be sent to legal@gigpay.com. GigPay may, in its sole discretion, terminate the accounts of those who are accused of copyright infringement or other intellectual property rights.

Intellectual Property
For any image, footage, text, audio, design or any other content that you upload, create, transmit or post to or through the Platform (“User Content”), you represent and warrant that: (i) User has all necessary rights to submit User Content to the Platform and grant the licenses set forth herein; (ii) GigPay will not need to obtain licenses from any third party with respect to use, publication, royalties or other fees, costs or expenses; (iii) User Content does not infringe any third party’s rights, including intellectual property rights and privacy rights, in any way; and (iv) User Content complies with these Terms of Service and all applicable laws. Subject to your compliance with these Terms of Service, GigPay grants User a limited, non-exclusive, non-assignable, non-sub-licensable, revocable, license to use the Platform as it is provided to you by GigPay solely for your personal or internal business use and only in a manner that complies with these Terms of Service and all legal requirements that apply to you or your use of the Platform. Notwithstanding the foregoing, GigPay reserves the right to and may revoke this license at any time, in its sole discretion. No licenses or rights are granted to User herein by implication or otherwise under any intellectual property rights owned or controlled by GigPay or its licensors, except for the licenses and rights expressly granted in these Terms of Service. You agree that you will not contest or otherwise challenge (e.g., in any legal action or otherwise), or assist or encourage any other person or entity to contest or challenge, the validity of any of GigPay intellectual property (whether registered or unregistered). You may not at any time, adopt or use, without GigPay’s prior written consent any word or mark which is similar to or likely to be confused with GigPay’s intellectual property. You are advised that GigPay will aggressively enforce its intellectual property rights to the fullest extent of the law. User grants GigPay a worldwide license to use User Content in connection with the Service.
All trademarks, service marks, trade names, trade dress and related intellectual property rights in the Services are proprietary to GigPay. You may not use, reproduce or display any of GigPay’s trademarks except upon GigPay’s prior written consent. The Platform and its entire contents, features, and functionality (including but not limited to all web pages, user interfaces, information, design, software, source code, text, displays, graphics, images, videos, and audio recordings, and the design, selection, and arrangement thereof) are owned, controlled, or licensed by GigPay, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Except as expressly provided in these Terms of Service, you may not copy, display, distribute, transmit, transfer, link to, reproduce, license, frame, alter, create derivative works of, reverse engineer, or republish all or any portion of the Site for any commercial or public purpose without GigPay’s prior written consent. You may, however, view information available on the Site for your informational purposes. You may download from the Platform materials, except for software or source code, but only for your personal or internal business purposes only. Your use of the Services, including the Platform, imposes on you an obligation of appropriate use and conduct, which includes, but is not limited to, not causing an unreasonable or disproportionately large processing load on our Services or systems, not engaging in any conduct that restricts or inhibits use of the Services by others, and not introducing or transmitting any virus, worm, Trojan horse or other material that may harm or disrupt our Services or systems. Unauthorized use of the Services, misuse of passwords, or misuse of any information or material posted on this Platform is strictly prohibited. You may use the Services, including the Platform, only for lawful purposes and you agree not to use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
Use of Information
You consent to our use and disclosure of any information submitted to us via GigPay, or information collected when you access GigPay in any manner permitted by law, and you acknowledge that you have no expectation of privacy, confidentiality or privilege in such information. GigPay will use Non-Personally Identifiable Information and Personally Identifiable Information (1) to market our products and services to you, (2) to provide services and products requested by you, (3) to enable our vendors and contractors to provide and assist us in the marketing, operation, troubleshooting and analysis of the Platform and other services, and (4) to engage in any other lawful activities we believe are consistent with the foregoing. We may provide any of these services through third parties, which may necessitate sharing Personally Identifiable and Non-Personally Identifiable Information with them.
We may also use and disclose Personally Identifiable and Non-Personally Identifiable Information in certain instances, including but not limited to; investigate and help prevent potentially unlawful activity or activities that threaten the integrity of the Platform or network; to protect and defend our rights or property or the rights or property of others; as required by courts or administrative agencies; and in connection with a financing, sale, merger, or reorganization of our business or assets. Any successor in interest to our business would acquire the information we maintain, including Personally Identifiable Information, and may alter the terms of this Privacy Notice.
Opt-out Policy
We may send you email and/or SMS text communications with account alerts, updates, marketing materials, service announcements and other information. If you prefer not to receive SMS or email communications from us, you may unsubscribe completely by emailing us at: support@gigpay.com to unsubscribe. Please note that opt-out requests may take up to seven (7) days to process and may require us to close your account given the importance of such communications to our Platform. We do not permit users to delete their account entirely but instead to designate it as inactive. Once an account is designated as inactive, the user can no longer login into GigPay. You may also clear cookies from your computer via your web browser settings. You may also wish to use a Google Analytics opt-out browser add on. Information on this option is available at: https://tools.google.com/dlpage/gaoptout. We are not responsible for removing your Personally Identifiable Information from the lists of any third party who has previously been provided your information in accordance with this notice.
Security
We use our commercial reasonable best efforts to secure access to Personally Identifiable Information in our possession, but will not be liable for any failure to safeguard such information, whether inadvertent or otherwise. Personally Identifiable Information is also stored with third parties who have informed us that they also use reasonable efforts to secure access to Personally Identifiable Information, but we will not be liable for the failure of any third party to safeguard Personally Identifiable Information, whether inadvertent or otherwise. We can provide no guarantees that our scurrility measures will be adequate or effective and prevent the growing trend of cyber-crimes which have been committed against larger more advanced financial institutions in recent years.
Children’s Privacy Policy
GigPay is not intended for use by children or teenagers, especially those under age 18. No one under age 18 is allowed to use the site, provide any personal information or receive our email distributions. We do not knowingly solicit or collect Personally Identifiable information from children or teenagers under the age of eighteen. If you believe that a minor has disclosed Personal Information to GigPay, please report this to us by emailing support@gigpay.com
Changes to Notice
We reserve the right, in our sole discretion, to change, modify, add, or remove portions of this notice at any time. Any changes or updates will be effective immediately upon posting to the web site. You should review this notice regularly for changes, and can determine if changes have been made by checking the Effective Date below. Your continued use of the Platform following the posting of any changes to this notice means you accept such changes.
GigPay’s Security Policy
GigPay takes steps to safeguard your personal information through physical, electronic and operational policies and practices. Data can only be read or written through defined service access points, the use of which is password-protected. Access to the system, both physical and electronic, is limited to only those employees or third parties who have a need to know. We do not allow visibility of your Social Security or business tax ID number or bank account information via GigPay.
Passwords
At a minimum, we require the use of both numbers and letters in your password. We have also instituted secure steps by which you can regain access to your account should you forget your password, including the use of a security question. Your password is not known to any employee or third party with whom we may partner, and we will never ask for your password as a means of identifying yourself. You should never share your password with anyone, and if you ever receive an email purporting to come from GigPay that asks for your password, you should immediately report this development. In addition to our own substantial efforts, you can take several precautions to protect the security of your computer and personal information. For instance, you can start by using a well-chosen password. You should avoid using any information that others can easily learn about you, such as a family member’s name or birthday, and you can also use special characters in place of letters. In addition, we recommend that you change your password frequently. You can install and regularly update antivirus and firewall software to protect your computer from external attacks by malicious users. When you are finished with a session on our site, be sure that you log out and close the browser window. The security offered through notifications can be undermined if other people have access to your email account or cell phone. Therefore, you might consider restricting access to the cell phone as well as the email account you registered with on the Platform and/or frequently changing your password on your email account. If you use a computer that is accessed by other people, such as in a public library or Internet cafe, we recommend that you take special precautions to protect the security of your Account and personal data. When you are finished using the Platform, you should log out completely, then close the browser window and clear the browser’s cache files.
You should also be aware of fraudulent attempts to gain access to your account information known as “phishing.” Phishing is a tactic used by scammers in which unsuspecting people are brought to a website by a genuine-looking email or SMS text message purporting to be from a legitimate company, this can also occur in applications such as WeChat, WhatsApp and Telegram, as well as social media communications such as on Facebook and others, and even in communications on gaming applications such as Roblox and others. The phony or “spoof” message takes the person to a website or application that looks legitimate but in fact is not. Either in the message itself or on this fake site, scammers may obtain login information to gain access to people’s GigPay accounts and transfer or withdraw your money. Note that GigPay will never ask you for your login information in the context of any message. In general, it is exclusively your duty and obligation to protect yourself against phishing by never providing personal or login information via such messages—instead, always go to gigpay.com directly, typing that into the browser yourself. You should make it a habit to check the URL of a website linked in any message to be sure that it is the correct domain. In the case of GigPay, you should always ensure the URL begins with https://www.GigPay.com
Compliance With State and Federal Laws
This privacy policy may not constitute your entire set of privacy rights, as these may also vary from state to state. To be certain of your privacy rights, you may wish to contact the appropriate agency in your state that is charged with overseeing privacy rights of consumers. Certain regulations issued by state and/or federal government agencies may require us to maintain and report demographic information on the collective activities of our membership. We may also be required to maintain your personal information for at least seven years in order to be in compliance with applicable federal and state laws regarding recordkeeping, reporting and audits.
Changes to This Policy
Any updates to the Privacy Policy become effective when we post the updates on the Platform. Your use of GigPay following the update to the privacy policy means that you accept the updated privacy policy. Any personal information you submit will be used solely to respond to your requests.
